It’s often overlooked, but the most important element of the GOP’s victory in the 2016 presidential election was the retention of control of the Supreme Court. Had Hillary won, it’s likely that there would not be a conservative majority on the court for the foreseeable future, effectively empowering liberals in perpetuity.
The conservative majority is slim, especially considering the wishy-washy nature of the likes of Kennedy and Roberts, which is why there’s hope that Trump will get the opportunity to fill another seat, preferably a liberal one. That’s the dream, but it looks like the only chance that’s happening is if he wins in 2020, as the most liberal and anti-American judge in the court’s history has announced she has no intention of retiring and giving the president the chance to fill her seat.
As reported at the New York Post, the 84-year-old Supreme Court Justice Ruth Bader Ginsburg has said that she’ll be holding onto her seat at least until 2020, to see how the presidential election shakes out.
Ginsburg is the eldest member of the court, but she’s just as busy as ever. She’s been making the rounds to various left-wing events, trashing Trump when the opportunity arises, and she’s even the subject of a new documentary about her life on the court.
It’s been speculated that should Hillary have won, she would have retired so a young leftist could take her spot. But the surprise victory of Trump has altered her plans, as she’s hired more law clerks to help her make it through June 2020, just four months before the next presidential election.
“I think that Justice Ginsburg has made clear that she has no intention of retiring. I am sure she wants to stay on the court until the end of the Trump presidency if she can,” said Erwin Chemerinsky, the dean of the law school at the University of California, Berkeley. Back in 2014, Chemerinsky called on Ginsburg to retire so Obama could replace her so they could avoid the risk of a Republican winning in 2016.
But Chemerinsky noted, “No one can know whether she will be on the court on Jan. 20, 2021, if Trump serves one term, let alone Jan. 20, 2025, if he is re-elected.” Ginsburg is the perfect example of what we don’t want our federal judges to be like.
She rules based on her feelings and left-wing ideology, rarely using the Constitution as anything other than a doormat. She’s even invoked foreign laws to justify her decisions. She’s even wryly referred to herself as “a flaming feminist litigator,” which barely scratches the surface of how extreme and out of touch with us plebeians she is.
Nothing would be better than Trump filling her seat with a conservative. We’ll just have to hope her 2020 holdout will be for naught.
